| [98 | Abstract] | In view of the National Socialist persecution of the Jews, it is quite surprising that most Jewish cemeteries, although badly damaged, survived the NS regime. Local districts especially urged implementing a quiet anti-Jewish measure of confiscation, closure and transference of property. However, unlike what happened in all other sectors of society, there were no anti-Jewish Sonderrechte regulating the disposal of the dead (or funerary procedures) during the entire span of the NS regime. In 1939/40 a drawn up Reichsfriedhofgesetz was not put into effect out of tactical consideration of Christian churches. Regional law (Landesrecht) dating from the time before 1933 could thus prevail unencumbered. In the early 1940's, Aryanization of cemeteries failed in several cases because of the sheer confusion in the "polycratic" structures of National Socialist government. Based on new sources this text describes how Jewish cemetries survived and addresses the complicated conditions after 1945 when, in the context of Wiedergutmachung, Jewish cemetries were restored and maintained. |
